State pauses pay equity program for comments, POLITICO New York Whiteboard

The Cuomo administration is soliciting comments on an existing executive order that will require state contractors to submit payroll information broken down by race and gender, an attempt to stem pay discrimination that has drawn concern from some business leaders.

The administration quietly posted guidelines, updated forms and ways to submit comments on Empire State Development's website shortly before the close of business on Thursday. Alphonso David, the governor's counsel, said last week that the administration would be flexible and has been talking with affected businesses for weeks.

The Business Council of New York State, which has raised concerns about the executive order, said it hoped there would be more than a pause.

"We are pleased to see the administration delay finalization of their contractor pay disclosure mandate and allow for review and comment by the state's vendor community," Heather Briccetti, the organization's president, stated. "However, a mere delay is not enough. There are significant issues with Executive Order 162. We urge the administration to re-examine the order, and recognize it is impractical, overly-burdensome and will have a negative impact on employers doing business with New York State."
